Dispute Resolution, Remedies, Choice of Law, Jurisdiction and Venue
Your access to or use of eSwarm signifies your understanding and agreement that the laws of Wyoming govern any dispute, issue or claim arising from use of this site, the 2nd Judicial District Court of Wyoming has exclusive subject matter and personal jurisdiction and is the exclusive venue for all such claims and you waive contrary rights.
Limitations on Liability
Use signifies your agreement that eSwarm can have no liability to you and makes no guarantees, warranties or claims whatsoever, including to continuous or secure access to eSwarm.
Use signifies your agreement that all services and applications on eSwarm are provided “As-Is” and you assume all risks.
Use signifies your agreement that eSwarm expressly disclaims and excludes all representations and warranties, express or implied, including title, merchantability, fitness for a particular purpose and non-infringement; and that eSwarm is not liable to you for any loss and you waive all contrary rights.
Use signifies your agreement that eSwarm’s aggregate liability for any claims that prevail against such limitations is limited to $10 (USD).
Prohibited
You will not introduce abusive or defamatory content, Spam or destructive code.
You will not introduce, nor benefit from, data-gathering methodologies.
You agree to hold harmless, indemnify and reimburse eSwarm for any harm caused if you intentionally violate this TERMS OF USE and for eSwarm’s remedial actions.
